Abstract

In this article the following legislation is analyzed: administrative-tort law of the Republic of Belarus that provides liability of the person according to the clause 18.15 of the Code of administrative offences for driving under the influence of alcohol, Road traffic regulations of the Republic of Belarus, other law acts, including the ones that regulate the procedure of examination of road traffic participants in order to estimate the condition of being under the influence of alcohol. The author also examined administrative-jurisdictional activity of departments of state road police of the Ministry of internal affairs of the Republic of Belarus in such category of cases. The author took an oral polling among road traffic participants in order to find out their knowledge of the lowest amount of alcohol that can be in blood of the road traffic participant, in case of its exceeding there is an administrative liability for driving under the influence of alcohol. Taking into account the research that was done, the author offers to make an amendment of the clause 18.15 of the Code of Administrative offences.
